Nevada Gaming Regulators Strike Back: Kalshi Faces Enforcement Action

Nevada regulators are moving to shut down Kalshi’s event contracts after the Ninth Circuit denied an emergency stay.
Kalshi’s ambition to offer sports-style event contracts in Nevada has hit a significant roadblock. This week, the US Court of Appeals for the Ninth Circuit denied the company’s emergency request for an administrative stay, effectively stripping Kalshi of its short-term legal shield.
With no court order in place to block state intervention, the Nevada gaming regulator acted immediately. The state initiated a civil enforcement case in state court the same day the Ninth Circuit handed down its decision.
Understanding the Ninth Circuit Denial
An administrative stay is typically used as a temporary "pause button" to prevent enforcement while a court considers a more permanent stay request. By refusing this relief, the Ninth Circuit has allowed Nevada to proceed with its crackdown.
Nevada’s stance remains firm: regardless of the labels used by Kalshi, the product functions as sports wagering. Consequently, the state argues it must fall under Nevada’s rigorous licensing and compliance framework.
The Fight for Jurisdiction
Following the state court filing, a new procedural battle erupted. Nevada alleges that Kalshi removed the case to federal court within hours, a move the state views as a delay tactic. Nevada has since filed for an expedited remand back to state court.
The state argues that:
- Nevada law requires enforcement actions to be heard in state courts.
- Federal preemption is merely a defense, not a valid reason to relocate the entire case to a federal venue.
Federal Markets vs State Gambling Law
At the heart of this conflict is a fundamental question of jurisdiction. Kalshi contends that its event contracts are regulated under the federal commodities framework, which should preempt state-level gambling enforcement.
Nevada rejects this, viewing the platform as an unlicensed sports betting operation targeting its residents. This case is a landmark moment for the US market, testing whether federally regulated "event contracts" can bypass the traditional state-by-state gaming license process.
What Lies Ahead
The legal battle is now moving along two parallel tracks:
- The Appeal: Kalshi continues to seek a merits-based stay to protect its operations during the broader appeal process.
- The Venue Battle: If the case is remanded to state court, Nevada can pursue rapid injunctive relief under its specific gaming statutes.
For now, the momentum has shifted toward the state. Nevada is currently positioned to act first, forcing the larger questions of federal jurisdiction to be settled later.
